Leon Benson was 22 years old when he was arrested for the 1998 murder of Kasey Schoen in Indianapolis. The prosecution’s case relied primarily on an eyewitness who identified Benson even though her initial description of the gunman did not match his appearance, and on statements from another witness whose account changed. Benson maintained that he was nearby but did not commit the shooting, and witnesses supported his account of where he was when the gunfire occurred. Police had received substantial information implicating another man, Joseph Webster. Witnesses identified Webster as the shooter, reported that he possessed the same type of firearm used in the murder, and described clothing that matched the gunman’s clothing. Investigative notes also indicated that Webster had been seen near the victim’s truck and had reportedly bragged about the shooting. Dozens of pages containing this evidence were not provided to the prosecution or Benson’s defense. Benson’s first trial ended with a jury unable to reach a verdict. At his second trial, his defense attorney failed to present important witnesses and did not fully challenge the evidence implicating Webster. Benson was convicted of murder and unlawful firearm possession in 1999 and sentenced to 60 years in prison. A reinvestigation by the University of San Francisco School of Law’s Racial Justice Clinic and the Marion County Prosecutor’s Office Conviction Integrity Unit uncovered the suppressed evidence and additional problems with the witness testimony. Benson’s conviction was vacated, the charges were dismissed, and he was released in March 2023 after spending more than 24 years in custody, including 11 years in solitary confinement.
